AGREEMENT TO SELL AND PURCHASE

 

This agreement is made at Delhi on this 18th day of December, 201# between: SMT. —— ———- W/o SHRI ——- ——– ——- R/o FLAT No.##, ————- APARTMENTS, PLOT No.##, ——. EXTENSION, —————————–, DELHI-1100##, hereinafter called the First Party of the one part

(1) SHRI ————— —————- ———- S/o LATE —- —–. —- (UID No-################## , PAN No-##################) & (2) SMT. ————–          ———— W/o SHRI ————–            ————————            ————–(UID No- ########## PAN No-##########) BOTH R/o ###, ——— KHAND, ———————— NAGAR, ———- VIHAR, PHASE##, DELHI-110095, hereinafter called the Second Party of the other part.

 

The expression first and second party occurs in the body of this Agreement shall mean and include their respective legal heirs, successors, legal representative, administrators, executors and assigns.

 

WHEREAS the First Party is the absolute Owner and in lawful possession of Duplex Flat No.##, on Third Floor, comprising of Three Bedrooms, One Drawing Cum Dining Room, One Kitchen, Three Toilets cum Bathrooms and Two Balconies, plinth/covered area 97.58 Sq. Mtrs., (Four Storied Building), situated in the layout plan of ———- CO-OPERATIVE GROUP HOUSING SOCIETY LTD., built on Plot No.##, known as ——— Apartments, —. Extension, —————-, Delhi-11##, against Membership No.____ with the said society.

 

That the first party for his legal needs and requirements has agreed to sell the said flat for a sum of Rs.##,00,000/-(Rupees ———- Five Lakhs Only) to the second party. Both parties i.e. first & second have agreed to sale/purchase of the said flat on the following terms & conditions of this agreement.

 

NOW THIS AGREEMENT WITNESSES AS UNDER:-

 

  1. That the entire consideration amount of the flat is finalized for a sum of ##,00,000/-(Rupees ——– Five Lakhs Only).

  1. First Party has received an amount of Rs.7,50,000/-(Rupees Seven Lakhs Fifty Thousand Only) vide Cheque No.______________ dated __________ drawn on ___________________________________________ as earnest money from the second party at the time of signing this agreement.

 

  1. Balance payment of ##,50,000/-(Rupees —- Seven Lakhs Fifty Thousand Only) shall be paid by the second party to first party on or before 21-03-20## at the time of handing over vacant possession and execution of transfer documents in favour of second party or his/her nominee(s) or any other person.

 

  1. First Party assured second party that the said property under sale is free from all kinds of encumbrances, sale, gift, liens, legal laws, court decrees, court injunctions, attachments whatsoever and if it is proved otherwise the first party shall be liable and responsible for the same.

 

  1. That all the expenses of this transaction (i.e. registration shall be borne by the second party only).

 

  1. If the first party shall be defaulter to comply any terms & conditions of this agreement and fail to execute the concerned documents for transfer the ownership of this said property in favour of second party in the office of concerned S.R. as per the fixed period by this agreement, then the first party shall have to pay double amount of earnest money to the second party.

 

  1. First Party shall pay the house tax, water/Electricity bill if any, till the date of final transaction. And the second party shall deduct the @1% TDS on registry amount on or before the final transaction and will have to hand over the TDS certificate to the first party the time of execution of Sale Deed.

 

  1. That the First Party shall clear all the Society dues till date at his own cost and expense, gets the NOC from the Society and shall also handover the possession of the said flat to the Second Party.

 

  1. If the second party fails to arrange the payment of the balance amount as per clause 3 above, the transaction will be considered as cancelled and the earnest money given will be forfeited.

  1. That the First Party shall also handed over the original share certificate, Possession Letter, Allotment Letter & Conveyance Deed etc. to the second party.

 

 

  1. That this sale transaction has been finalized through M/s. ———— Property signed through its Proprietor Mr. —– Kumar, he will be paid #% commission each by the seller and purchaser. The defaulter party shall pay #% commission to the said dealer.
